SHORT DESCRIPTION OF THE NATIONAL FLC SYSTEM
Montenegro opted for a centralised control system. Control activities are carried out by the Directorate for Finance and Contracting of the EU Assistance Funds (CFCU) within the Ministry of Finance. The Montenegrin FLC Division performs verification of expenditures for trilateral and transnational programmes. The Ministry of Finance and Economy is responsible for the FLC control system.
Controls are carried out free of charge for the partners.
On-the-spot verifications conducted by FLCS
On-the-spot checks are mandatory in Montenegro at least once during the project or more if deemed necessary.
In Montenegro, daily allowances for travel and accommodation costs are applicable to public partners.
Private partners, except of non-profit organizations, aren't eligible in IPA countries. As for non-profit organizations, they can apply their internal rules or EU per-diem rates.

In terms of implementation of projects funded by EU, Montenegrin partners follow “Procedures and practical guide” (PRAG). Otherwise, it is the Law on Public Procurement which regulates the issue. Montenegro recommends to all users to follow and apply PRAG rules.
In the framework of projects funded by Interreg MED Programme, Montenegro recommends applying “Procedures and practical guide” (PRAG) for public procurement, and both for public and private partners.
This section provides a clarification of the Montenegrin regulation regarding natural persons working for the partner institution, in order to help partners before claiming such expenditure. Taking into account that the national regulation on this issue might be different from country to country, the Programme does not provide a generally applicable definition of the terms used. Partners are required to clarify this according to national law and their institutional regulation, as well as with their first level controllers.
In Montenegro, regarding the concept of « natural person », there are two types of contracts usually in use: temporary service contract and Consultancy Agreement. NCP engaged and paid under the 1st budget line – staff cost, is hired under the Consultancy Agreement. These are regulated by the Law on Obligations, and the Insurance Law.
The Law on Obligations regulates the obligation relations originating on the ground of contract, the fact of causing damage (torts), acquiring without proper grounds, management of another’s affairs, unilateral declaration of intention, and other facts as laid down by law.
The Insurance law governs the conditions and method of performing insurance business and supervision of the performance of insurance business.
